TERMS OF SERVICE

These Terms of Service are entered into between you and Tech Under Motion QR (“TUMQR,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our website at www.tumqr.ca and our dynamic QR code hosting, URL redirection, and analytics services (collectively, the “Services”).

By purchasing, subscribing to, accessing, or using the Services, you agree to these Terms.

1. Services Overview

We provide dynamic QR code hosting and URL management services. Dynamic QR codes allow subscribers to point a printed or digital QR code to a designated destination URL and update that URL destination at any time through our platform.

2. Subscriptions, Fees, and Payment

2.1 Billing Structure

  • Setup Fee: A one-time, non-refundable setup fee of $40 USD is charged upon initial purchase to cover custom onboarding, account configuration, and system allocation.
  • Annual Subscription Fee: An ongoing recurring subscription fee of $100 USD is billed at the time of purchase and automatically renews every twelve (12) months thereafter unless canceled.
  • Initial Billing Total: Your first payment consists of the $40 USD setup fee plus the $100 USD annual subscription fee, for a total base price of $140 USD, plus applicable taxes.
  • Localized Pricing: Prices are established in U.S. dollars (USD). Where available, our payment processor may display and charge the equivalent amount in your local currency. Localized prices and currency conversion rates are determined at checkout and may vary over time.

2.2 Recurring Automatic Renewal

By enrolling in an annual subscription, you authorize us to charge your payment method on file via Stripe automatically on each annual renewal date until you cancel.

We may change subscription pricing from time to time. Any price change will apply only to a future renewal and will be communicated in advance as required by applicable law.

2.3 Taxes

Fees are exclusive of applicable taxes. GST, HST, PST, QST, state or local sales taxes, or other applicable taxes may be calculated and added at checkout where required by law.

2.4 Cancellation Policy

You may cancel your subscription at any time by contacting us at hello@tumqr.ca.

  • Cancellation stops future automatic renewals.
  • Your QR codes will remain active and functional until the final day of your current paid annual billing period.

2.5 Refund Policy

All fees (including the setup fee and annual subscription fees) are non-refundable. We do not provide prorated refunds or credits for partial annual subscription periods or unused scans.

3. Account Responsibilities & Acceptable Use

3.1 Account Creation & Security

You must provide accurate and current contact, billing, and service information. You are responsible for the accuracy of information associated with your Services.

3.2 Prohibited Redirect Content

You agree that you will not use our dynamic QR codes to redirect users to websites or content that contain:

  • Malware, spyware, phishing schemes, or malicious executables.
  • Illegal goods, services, or unlawful activities under local or international law.
  • Hate speech, harassment, sexually explicit content, or fraudulent marketing.

We reserve the right to immediately suspend or permanently disable any QR code or account that violates these terms without notice or refund.

4. Service Availability & Redirection Integrity

4.1 Uptime & Redirects

While we strive to maintain high service availability (uptime), we do not guarantee uninterrupted operational availability of URL redirection servers. Service interruptions due to server maintenance, ISP outages, or third-party infrastructure failures may occur.

4.2 Responsibility Disclaimer

You are solely responsible for testing and verifying your QR codes prior to mass commercial printing or production. We are not responsible or liable for printing costs, media replacement fees, or business losses incurred due to incorrect target URLs or unverified QR code graphic designs.

5. Termination & Expiration

If your annual subscription is canceled, expires, or remains unpaid following a failed renewal attempt, TUMQR may suspend or deactivate the associated QR codes and landing pages.
We reserve the right to delete account records and QR code routing configurations after ten (10) days of non-payment.

6. Intellectual Property

We retain all right, title, and interest in our website, software platform, redirect infrastructure, and proprietary analytics tools. You retain ownership of all original destination content, logos, and trademarks linked through your QR codes.

7. Customer-Provided Content and Setup

Customers are responsible for ensuring that all information, photographs, logos, trademarks, links, social media accounts, listing information, contact information and other materials supplied to TUMQR are accurate and that they have the necessary rights or permissions to use them.

TUMQR may configure and publish QR landing pages using information supplied by the customer. Customers are responsible for reviewing their completed page and notifying us of any errors or required corrections.

The annual subscription includes continued hosting and operation of the dynamic QR code and associated TUMQR landing page, together with reasonable content updates to existing information. Major redesigns, additional QR pages, custom development, or services outside the original package may incur additional fees, which will be disclosed before work begins.

Important: Because TUMQR QR codes are dynamic and rely on our hosted redirection service, the QR code may no longer direct visitors to the customer’s content after the paid service period ends. Customers should consider this before printing the QR code on permanent or long-term materials.

7.1 Third-Party Links and Services

TUMQR landing pages may contain links to third-party websites and services, including social media platforms, real estate listing services, booking platforms, customer websites, and other external services. TUMQR does not control and is not responsible for the availability, accuracy, content, security, functionality, or privacy practices of third-party websites or services.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Tech Under Motion QRshall not be liable for any indirect, incidental, special, consequential, or punitive damages—including loss of profits, revenue, data, printing costs, or business reputation—arising out of your use of or inability to use the Services.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada without regard to conflict of law principles.
